    • Referring to the wages case, Woolliscroft v. Tooth, heard recently in the Court of Petty Sessions, Toowoomba, the Courier of Tuesday last says: In Chambers, yesterday, before His Honor Mr. Justice Lutwyche, in the matter of the application of W. B. Tooth for a writ of prohibition against H. Spiro and Samuel Bennett Bailey and Ellen Woolliscroft, Mr. Blake, Q.C., instructed by Mr. Dalby (office of Mr. Thynne), moved rule absolute. The Attorney-General, instructed by Mr. Daly, showed cause on behalf of Ellen Woolliscroft. This was a case under the Masters and Servants Act, 25 Victoria, No.11; the principal point being that the magistrates had no jurisdiction to hear the case of Woolliscroft v Tooth at Toowoomba, that place being forty miles from Clifton, the place where, the defendant resided, and where the plaintiff was in his service. The Attorney General also contended that this was a common law prohibition which could not be determined by a Judge in Chambers. Mr Blake, in reply, argued that, under the third subsection of section 2 of the Masters and Servants Act, the case should have been heard at the nearest place where a Court of Petty Sessions was held, such place being Allora, which is about ten miles from Clifton. After considerable argument. His Honor said that he felt some difficulty in dealing with the third subsection of section 2 of the Act, under which this case bad been brought, and he should adjourn the matter to the full Court for hearing on the first day of next term.
