    • COURT OF REQUESTS.
      - £10 JURISDICTION
      [Before Mr. Commissioner TARLETON.]
The monthly sitting of this Court was held yesterday, when the following cases were disposed of :
PITT v WILLISCROFT -This was an action for the unlawful detention of a sewing machine. Mr. SIMMONS (Clark and Simmons), was for the plaintif, and explained that Mr. Pitt had supplied a sewing machine on hire to a person named Mrs. Parker. The machine had not been paid for. It appeared that Mrs. Parker had been lodging with defendant, and was owing him a certain sum
for rent. Defendant ««««as now retaining the machine on account of the rent. Mr. S. B. Pitt, the plaintiff, said Mrs. Parker came to him on December 21 last year, and got a sewing machine supplied to her on approval, the understanding being that if she approved of it site would pay the usual deposit of £1, and sign tho usual biro agreement. She did not, however, do either. The sewing machine was delivered at Mr. Williscroft's house, 10, Liverpool-street.
The value of the machine was £9 18s. Mrs. Parker was to have given her decision in a week, but she put off doing so. About five weeks after the delivery of tho machine he went to the house, and was informed that Mrs. Parker had left. He could not learn where she had gone. Defendant carne to him in the evening that day, admitted having the machine in his possession, and said he was keeping it in lieu of money due to him by Mrs. Parker. He refused to give it up unless his claim was paid. Alexander G. Williscroft, the defendant, said he claimed to hold the machine in payment of the account for rent due by Mrs. Parker. He claimed £2 5s. for rent, and 15s. for wood and coal. Mrs. Parker left on February 12th. He did not know that if he had a claim for rent, he should, as landlord, have distrained and sold the goods within 15 days. Mr. SIMMONS Submitted, on behalf of the plaintiff, that defendant had only a claim in respect of rent, and as landlord lie should have distrained within 15 days. No having done so he had no defence as against Mr. Pitt's claim. Judgment was given for the plaintiff, and defendant was ordered to return the machine.
